On January 21, Representative Matt Gray and Senator Faith Winter introduced the Colorado False Claims Act for consideration during the 2022 Colorado legislative session. Like most state false claims acts, the Colorado False Claims Act is largely patterned after the federal False Claims Act. However, the Colorado False Claims Act does contain a number of unique provisions and expands retaliation protections for whistleblowers. If passed into law, the Colorado False Claims Act would be in addition to the current Colorado Medicaid False Claims Act. Claims for payment under the Colorado Medicaid program are specifically excluded from the proposed Colorado False Claims Act.
